The concept of topos, despite its frequent use across theoretical traditions, remains notorious-ly elusive and resistant to rigid categorization. This article addresses the problem of conceptual ambiguity and semantic multiplicity associated with topoi, focusing particularly on their role in legal reasoning, where they are key elements of non-deductive argumentation. The object of this study is to reconstruct the most recurrent meanings attributed to the term, identifying its central conceptual and functional features. The method employed is a critical and comparative reading of specialized literature, grounded in legal topics and enriched by insights from the philosophy of language, rhetoric, argumentation theory, and discourse analysis. Rather than fixing a closed defi-nition, the article proposes a cartography of topoi operations across discursive fields. The analysis is structured around three main axes: general characteristics attributed to topoi; their practical functions in argumentation; and a proposed classification tailored to the legal field
O conceito de topos, embora recorrente em diversas tradições teóricas, apresenta uma notável heterogeneidade de sentidos e resistências à definição categorial rígida. Este artigo investiga o problema da polissemia e da ambiguidade conceitual dos topoi, especialmente no campo jurídico, onde desempenham papel central na argumentação não dedutiva. O objeto da pesquisa é, por-tanto, a reconstrução dos sentidos mais recorrentes atribuídos ao termo, com vistas a delimitar seus traços conceituais e funcionais mais característicos. Para isso, adota-se como método uma leitura crítica e comparativa da literatura especializada, com base na tópica jurídica e em apor-tes da filosofia da linguagem, da retórica, da teoria da argumentação e da análise do discurso. A investigação recusa a fixação de um núcleo conceitual fechado, preferindo uma cartografia das formas de operação dos topoi em diferentes contextos. A exposição organiza-se em torno de três eixos: as características gerais atribuídas aos topoi; suas funções práticas na argumentação; e uma proposta de classificação específica para o campo jurídico
