El presente artículo tiene como objetivo analizar los mecanismos de la construcción conceptual del estatus del ‘inmigrante irregular’. Es una categoría social que se configura mediante procesos jurídicos, políticos y sociales que le atribuyen significado y eficacia social a este término. Sin embargo, en los discursos éste queda fácilmente esencializado y se maneja como si fuera portador de un contenido natural y absoluto. Estas categorías, aún siendo construidas socialmente, estructuran la realidad y tienen efectos reales sobre ella. Tal carácter performativo de la realidad se va a considerar un elemento central a la hora de tratar el tema de la inmigración irregular. Primero, vamos a analizar la construcción del concepto del ‘inmigrante’ para pasar, a continuación, a la configuración de su estatus ‘irregular’. Más adelante, veremos con más detalle tanto el carácter político-jurídico como socio-cultural del proceso e indicaremos las consecuencias que tiene en la integración de las personas portadoras de tales categorías. El estudio se basa principalmente en los materiales referentes al contexto migratorio en España, en cuanto representante del modelo migratorio de la Europa del Sur, en los últimos años
Concepts that represent social reality decide upon the way we perceive it. The following text aims at the analysis of construction of the concept of an illegal/irregular immigrant. That social category is formed through judiciary, political and social processes that give particular meaning and social efficacy to the concept itself. It is worth mentioning that being socially constructed the concepts still structure reality and have real effects on it. However such concepts as illegal immigration or irregular migrant are often treated in an essential way and understood as denominating natural and absolute contents. The performative character of reality will be considered here as a central element within the issue of irregular immigration. First, the construction of the concept of immigrant will be discussed, followed by the configuration of the ‘irregular’ status. Political, judiciary and socio-cultural character of the process will be presented as well as consequences it exercise upon the persons described with such categories. The study is based on materials referring to migration issues of Spain during the last ten years
