El artículo analiza las motivaciones y argumentos que fundamentaron la aplicación de la clasificación de emigrados al conglomerado patriota chileno que recaló en la capital de la jurisdicción cuyana como resultado de la derrota de Rancagua en 1814, y el ejercicio de autoridad practicado en la jurisdicción por el gobernador intendente, José de San Martín, que asoció el territorio bajo su mando con las Leyes y el Gobierno Superior de las Provincias Unidas. Tales problemas prometen ser confrontados mediante la consulta del intercambio de oficios del gobernador cuyano con los hermanos José Miguel, Juan José y Luis Carrera y las autoridades de Buenos Aires junto a un repertorio de registros que atestiguan la tramitación del conflicto en la jurisdicción alojados en archivos locales. De su restitución emanan evidencias firmes del ejercicio de autoridad sanmartiniano sobre las nociones de soberanía y territorio que lo fundamentaron en las cuales prevalece el vínculo o dependencia de la jurisdicción o Provincia de Cuyo con el Supremo Gobierno de Buenos Aires.
The article analyzes the motivations and arguments that founded the application of the classification of emigrants to the Chilean patriot conglomerate that landed in the capital of the Cuyo jurisdiction as a result of the defeat of Rancagua in 1814, and the exercise of authority practiced in the jurisdiction by the governor intendant, José de San Martín, who associated the territory under his command with the Laws and the Superior Government of the United Provinces. Such problems promise to be confronted by consulting the exchange of letters of the governor of Cuyo with the Carrera family (los hermanos José Miguel, Juan José y Luis) and the authorities of Buenos Aires together with a repertoire of records that attest to the processing of the conflict in the jurisdiction housed in local archives. From their restitution emanate firm evidences of the exercise of authority by San Martín over the notions of sovereignty and territory that founded it, in which the link or dependence of the jurisdiction or Province of Cuyo with the Supreme Government of Buenos Aires prevails.
