La independencia del poder judicial es un principio básico de todo Estado democrático de Derecho. Así lo reconoció la Constitución Española de 1978, estableciendo como instrumento de garantía de esa independencia judicial un órgano de autogobierno de jueces y magistrados, con escasa tradición legislativa en nuestro país, pero muy arraigado en la realidad europea. La L.O. 6/1985 del Poder Judicial, confirmada constitucionalmente, transformó la naturaleza del Consejo General del Poder Judicial. Esta situación aún perdura pese a que la legislación europea reitera la necesidad de un cambio para adecuar el actual CGPJ a los estándares europeos.
The independence of the judiciary is a basic principle of every Democratic State of Law. This was recognized by the Spanish Constitution of 1978, establishing as an instrument to guarantee that judicial independence a body of self-government of judges and magistrates, with little legislative tradition in our country but deeply rooted in the European reality. L.O. 6/1985 of the Judicial Power, confirmed constitutionally, transformed the nature of the General Council of the Judicial Power. This situation still persists despite the fact that european legislation reiterates the need for a change to adapt the actual CGPJ to european standards.
