El trabajo de presentación versa sobre el derecho fundamental a la tutela judicial efectiva (art. 24.1 CE), su contenido y aspectos en que incide, principalmente en cuanto a la necesidad de conocer el proceso lógico-jurídico que conduce al fallo. Los aspectos que comprende: fundamentación del relato fáctico que se declara probado, subsunción de los hechos en el tipo penal procedente y las consecuencias punitivas y civiles en caso de condena. La motivación en las sentencias absolutorias, bastando la existencia de duda razonable. La inmodificabilidad de las resoluciones judiciales y el ámbito de los autos de aclaración. Por último, el derecho de acceso a los recursos y su diferente relevancia constitucional del derecho de acceso a la jurisdicción
The presentation work deals with the fundamental right to effective judicial protection (art. 24.1 CE), its content and aspects in which it affects, mainly in terms of the need to know the logicallegal process that leads to the ruling. The aspects it includes: substantiation of the factual account that is declared proven, subsumption of the facts in the appropriate criminal type and the punitive and civil consequences in case of conviction. The motivation in the acquittals, the existence of reasonable doubt being sufficient. The inmodifiability of judicial decisions and the scope of clarification orders. Finally, the right of access to resources and its different constitutional relevance from the right of access to jurisdiction.
